Welcome to Frezzpresso! Before you start using our services, please take a moment to read through our terms and conditions. By using our website or mobile application, you agree to abide by these terms.

1. Service Description

Frezzpresso is an online platform that connects users with restaurants and facilitates the delivery of food items. We act as an intermediary between users and restaurants.

1. User Responsibility

• You must be 18 years of age or older to use our services.
• You agree to provide accurate and up-to-date information during the registration process.
• You are responsible for maintaining the confidentiality of your account information and password.
• You agree not to use our platform for any unlawful or prohibited activities.

1. Ordering Process

• Users can browse through the available restaurants and food items listed on our platform.
• Once an order is placed, it will be forwarded to the respective restaurant for preparation and delivery.
• Payment for orders can be made online through various payment methods accepted by us.
• Frezzpresso is not responsible for errors in order details provided by the customer. Once an order is placed, it cannot be modified. The customer must ensure the accuracy of all information before finalizing the order.

1. Delivery

• We aim to deliver orders in a timely manner; however, delivery times may vary depending on factors such as traffic conditions, weather conditions and restaurant preparation time.
• In case of any delays or issues with the delivery, we will make our best efforts to notify you promptly.
• We will strive to deliver hot items using warmers and cold items using freezers. However, we are not responsible for any temperature changes after the item has been delivered and the customer has been notified.
• Customers will be notified of their delivery via the contact information provided at the time of the order. It is customer’s responsibility to ensure contact information is accurate and up to date.

1. Pricing and Payment

• Prices listed on our platform are exclusive of taxes and delivery charges, unless otherwise stated. Taxes and delivery charges will be applied at the end in subtotal.
• Payment for orders must be made in advance through our online payment gateway.
• We reserve the right to modify the prices of food items and delivery charges at any time without prior notice.

1. Refunds and Cancellations

• Refunds will be provided in case of order cancellations due to restaurant unavailability or other valid reasons.
• Refunds may take up to 7-10 business days to be processed and reflected in your account.

1. Intellectual Property

• All content and materials on our platform, including logos, trademarks, and text, are the property of Frezzpresso.
• You may not use, reproduce, or distribute any content from our platform without our prior written consent.

1. Limitation of Liability

• We are not liable for any damages, losses or expanses incurred as of result of using our platform or services.
• We do not guarantee the quality or safety of the food items delivered by restaurants.
• Our liability is limited to the amount paid for the specific delivery service.
• This limitation does not apply to damages resulting from our gross negligence or willful misconduct.

1. For vendors:

• Vendors will be charged 18.95% commission fee for Frezzpresso’s services, which is subject to change as Frezzpresso seems fit.
• Vendors will also be charged an annual fee of $99/year if vendor wishes to continue using Frezzpresso services. The annual fee is also subject to change as Frezzpresso seems fit. Frezzpresso will notify the changes in the fees to vendors before charging the vendor the new value of fee.
• Vendors have a right to cancel Frezzpresso’s membership at any time, however the following terms will apply.
  • Once the annual fee is charged for the upcoming year, vendors will not receive a refund for it. Therefore, vendors must ensure to cancel the membership before renewing the membership.
• Intellectual Property: Vendors retain ownership of their intellectual property rights pertaining to their products and services listed on Frezzpresso.
• Performance: Vendors have the right to expect timely payment and accurate reporting of transactions conducted through Frezzpresso. However, if errors occur in these areas, Frezzpresso will ensure to communicate the errors to the Vendor.
• Vendors will receive payments every two weeks.

1. For Drivers:

• Earnings: Drivers will receive tips and the delivery fee provided by consumers. The delivery fee is subject to change at Frezzpresso’s discretion.
• Fair Treatment: Drivers have the right to fair treatment, including timely payment for completed deliveries and respect for their time and effort.
• Safety: Drivers have the right to operate in a safe environment and to refuse delivery requests that pose safety concerns.
• Delivery Requirements: Drivers are required to utilize refrigerators and warmers for the delivery of products.

1. Governing laws

These terms and conditions are governed by the laws of United States. Any disputes arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts of New York.

Frezzpresso complies with all applicable federal, New York State, and local laws and regulations. Customers are responsible for ensuring their orders comply with any applicable laws.

1. Privacy Policy

Frezzpresso is committed to protecting customer privacy. Please refer to our privacy policy for details on how we collect, use, and protect your information. Our privacy practices comply with the New York privacy act, the General Data Protection Regulation (GDFR) where applicable, and the New York state SHIELD Act.

1. Changes to Terms and Conditions

Frezzpresso reserves the right to modify these terms and conditions at any time. Changes will be effective immediately upon posting on our website/ application. Continued use of our services constitutes acceptance of the revised terms.
